The rental agreement only includes the temporary rental of the holiday apartment and the shared use of generally accessible areas of the property. Additional services are excluded.

The agreement becomes effective upon booking confirmation from Zermatt Tourism or the landlord via email or letter.

Photos and text on the website serve as realistic description, but a 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings, provided they are of equal value.

Payment conditions

The additional costs (electricity, heating, bed linen, kitchen and bath linen, tourist tax and final cleaning) are included in the rental price. ​

100% of the rental price is to be paid no later than 45 days before the arrival date. For short-term reservations, the full amount is due at the time of booking.

Cancellation of the booking by the tenant

The tenant must inform the landlord as early as possible if they cannot commence the holiday. The landlord will try to find a replacement tenant but is not obliged to do so.

If the agreed rental period is not fully adhered to, the entire rent for the agreed rental period must still be paid.

It is recommended to take out travel cancellation insurance (suggestion under "Links") and liability insurance that covers damages to the rental property and/or its furnishings.

The following cancellation conditions apply:​

Up to 45 days before the arrival date: free of charge..

44 - 0 days before the arrival date: 100% of the price.

Cancellations made too late and no-shows: 100% of the price.

Cancellation of the booking by the landlord

If the payment deadlines are not met, the landlord may withdraw from the contract.

The landlord is entitled to cancel the rental agreement by email or letter within 5 days of the booking confirmation, or in the case of short-term bookings, until the rental price is received, without further notice.

Duties of care etc. during the rental agreement

The tenant must immediately report any complaints about the rental property to the landlord, Otherwise, it is assumed that the rental property and its inventory were in good condition.

The tenant and their cohabitants commit to using the rental property with care, adhering to the house rules, and being considerate of other residents and neighbours. In the event of gross violations of the duties of care, the landlord may terminate the contract without notice or compensation.

Pets are only allowed by arrangement.

Smoking is prohibited in the rental property.

The maximum occupancy of 2 persons must not be exceeded.

Return and departure

The tenant must return the rental property with all keys and the entire inventory in the same condition as upon arrival. This specifically means: broom-clean, refrigerator (do not turn it off) and cupboards emptied, dishes and pots cleaned, waste disposed of in the appropriate containers.

One key to the rental property is to be left in the apartment upon departure. The other key is to be used to lock the apartment and then deposited in the mailbox "Ruedi & Cathérine Rüegg, C 143" at the entrance of the house.

Liability for damage and loss

The tenant is liable for all damages to the rental property and/or missing inventory caused by them or their cohabitants (including guests). The burden of proof for non-culpability lies with the tenant. If damages are discovered only after the return of the rental property, the tenant is also liable for these, provided the landlord can prove that the tenant (or their cohabitants or guests) caused the damages.

The landlord is entitled to charge for all damages and missing inventory.

In the event of a key loss, a flat fee of CHF 100 will be charged.

Responsibility of the landlord

The landlord is responsible for proper reservation and contract-compliant fulfilment of the agreement.

The landlord is not liable for damages and losses of items belonging to the tenant, their cohabitants, and guests. The landlord assumes no responsibility for accidents and injuries resulting from the use of the rental property or access to the rental property/premises.

The landlord is not liable for influences on the rental property due to force majeure, power and water outages, storms, or unforeseeable and unavoidable circumstances such as official orders, sudden construction sites, or disturbances due to natural and local conditions.

The landlord's liability is excluded to the extent permitted by law.

Applicable law and place of jurisdiction

The contractual relationship and the General Terms and Conditions are governed exclusively by Swiss law (in particular articles 253 to 274 of the Swiss Code of Obligations).

The exclusive place of jurisdiction for any disputes arising from the contractual relationship and these General Terms and Conditions is Zermatt (location of the rental property).
